*A number of celebrities gathered for a tribute concert in celebration of the Queen Of Soul on Sunday, Jan. 13, and The AP reports that every rendition of Aretha’s Franklin’s songs brought audience members to their feet at the “Aretha! A GRAMMY Celebration For The Queen Of Soul” in Los Angeles.

According to Page Six, a montage of the late singer was shown throughout the show including one with onscreen quotes from former President Barack Obama, Barbra Streisand, Willie Nelson and Tony Bennett.

“Aretha set the bar,” a quote from Quincy Jones read.

Jennifer Hudson, who will star in Franklin’s biopic “Respect,” kicked off the tribute with a performance of “Think” and Keys and SZA took the stage for a duet of “Day Dreaming.”

Here are additional highlights via Page Six:

Celion Dion performed Franklin’s version of “A Change is Gonna Come,” and Patti Labelle served up a soaring rendition of  “Call Me.”

Fantasia, Andra Day, Brandi Carlile and Alessia Cara sang “Natural Woman” together, and Common joined Yolanda Adams for a performance of “Young, Gifted and Black.”

Smokey Robinson told the star-studded audience at the Shrine Auditorium that Franklin “was a gifted songwriter, a fantastic musician and a great formidable activist,” he said. “For me, she was my little sister who I loved so much. I still love her so much. But she’s gone home now to be with her father. I believe she has been reunited with her entire immediate family.”

The tribute was organized by the Recording Academy and music mogul Clive Davis, who told the crowd “There will never ever be another Aretha Franklin.”

Other performers included Shirley Caesar, Kelly Clarkson, Chloe X Halle, H.E.R., John Legend and BeBe Winans.

ET’s Nischelle Turner caught up with Dion at the event, who discussed her relationship with Franklin and what she learned from her.

“I’ve had the privilege of singing at [VH1’s] Divas with her and when I had one moment, I had one line I was not gonna mess on that,” she explained of her performance with the music icon in 1998. “I had a moment with her that I will never forget and I will cherish this for the rest of my life… I remember taking a picture with her after meeting with her, singing her [songs] of course, and when you love to sing so much, it’s gotta be done with the soul.”

The 50-year-old Canadian further explained how Franklin inspired her.

“You sing with your heart but she has taught us that, when we believe so much, that it comes from deeper than the heart, it comes from the soul,” she said. “So we did not invent those words, she gave those words. She put those words into our repertoire, into our lives and dreams…our performances.”

“I feel extremely, extremely fortunate and honored that they called me to pay tribute to her because I think that we all took through the years a little part of her,” she added. “We did not sing her tonight, we lived her.”

Franklin died in August at the age of 76 in her home in Detroit, Michigan, following a long battle with pancreatic cancer.

The concert event will air March 10 on CBS.

*Steve Harvey’s wife, Marjorie, has sparked a bit of outrage online after she shared a video of granddaughters Elle, 3, and Rose, 4, taking care of their baby dolls by pretending to breastfeed them.

When asked what they were doing, Rose responded, “Feeding our babies,” before Elle continued, “from our boobies.”

“Breastfeeding is normal and kids imitate what they see,” a follower commented. Another joked, “So sweet! Little do they know what’s to come when they really get there.”

Marjorie eventually responded to the criticism on her Instagram Stories, stating that she thought the video was funny.

“Cleary some of y’all weren’t breastfed. Maybe that’s the problem,” she said. “Some of y’all need a hug.”

*Jaqi Wright and her sister, Nikki Howard, are furloughed federal employees who have found a way to bounce back during this partial government shutdown, which began Dec. 22.

800,000 federal employees and contractors are reportedly affected by Trump’s shutdown, and Wright and Howard — who work for the Justice Department and Food and Drug Administration in Washington D.C., respectively — are concerned about how the lack of pay will impact their finances. per time.com.

Rather than accept defeat, the Maryland-based sisters decided to launch The Furlough Cheesecake on New Year’s Day — selling cheesecakes for $29.98 each.

“We don’t know when this is going to end. We don’t have a clue,” Howard, the baker behind the operation, says. “But instead of dwelling on that and feeling the depression that tends to come with these kinds of situations, we’re making a decision to do something else.”

According to the TIME report, it didn’t take long for the duo to get their business off the ground. “We have a little machine that’s working,” Howard says.

*Netflix users, get ready for price increase, as the streaming giant is raising monthly plans for all of its U.S. subscribers – again.

According to Deadline, it’s most popular plan will go from $11 to $13 per month. The increases will take effect immediately for new subscribers and will be phased in over three months for existing subscribers.

 

The company says the price increase will help pay for debt and original shows.

Here’s how the new plans breakdown:

The Netflix Basic plan will now cost $9, up from $8. The most popular option, HD Standard, will now cost $13, up from $11, while the 4K Premium plan will cost $16, up from $14. Customers in about 40 Latin America countries where will also be affected, per Deadline.

“We change pricing from time to time as we continue investing in great entertainment and improving the overall Netflix experience,” the company said in a statement to the Associated Press.

According to its last quarterly report, Netflix had 137 million subscribers worldwide, including 58 million in the U.S.

One Twitter user reacted to the price hike by writing: “Everyone bitching over $2 luke…why? Do you expect to keep paying nothing for awesome original add-free content? Thats not really how the world works…. might wanna climb off that entitled high horse…”

While another commenter noted: “I’ll continue paying $15/mo for the amazing content HBO puts out, but no, I am not paying $13/mo for 13 Reasons Why, House of Cards, or whatever other crap Netflix is putting out. And they will probably hike the price again in a few more years.”

This marks the fourth time the company has raised its U.S. prices. The last increase came in late 2017.

There are some concerns that higher prices could trigger a wave of cancellations.

*Rihanna is taking legal action against her father after he allegedly used her Fenty brand to make a come up of his own.

According to The Blast, the singer has filed a lawsuit against Ronald Fenty and a company called Fenty Entertainment. She claims her father and his business partner, Moses Perkins, created an entertainment company to exploit her name to try and get rich.

Rihanna has already trademarked “Fenty,” which she uses in a number of business ventures, including her Fenty Beauty line. The Bajan beauty makes it clear that she has nothing to do with Fenty Entertainment, and that “Although Mr. Fenty is Rihanna’s father, he does not have, and never has had, authority to act on Rihanna’s behalf.”

In both cases, RiRi claims the bookings occurred without her authorization.

The suit states that Rihanna has sent multiple cease and desist letters to Ronald Fenty, but he has ignored them and continues to earn millions from Fenty Entertainment.

She’s asking a judge to place an injunction on her dad using the name Fenty … and, of course, for damages.

Meanwhile, Rihanna recently revealed that her new album will arrive this year. When asked by a fan on Instagram when it will be released, she replied: “2019”.

*Yo gurl, Amber Rose is giving up the deets on her past life. It’s one that includes selling crack cocaine. But, she says she just wasn’t cut out for that kind life  and stepped back.

We know this because she recently made the confession – one she’s NEVER discussed openly before –  after sitting down for a raw convo about overcoming life struggles with TMZ’s Van Lathan on his Red Pill podcast. It was all about doing the selling crack thing to make ends meet when she was a teenager running around South Philly.

It turned out to be a failed effort, and not because she was ever caught. The guys in her neighborhood wouldn’t let her deal. Still, that didn’t throw a damper on Amber from dipping her toe into the drug world.

She also made an interesting point … she knows she’ll be judged harshly by some, but points out the double standard … people like Jay-ZJeezyPusha T and 50 Cent often get glorified for their dealings.

*R. Kelly’s ex-wife, Andrea ‘Drea’ Kelly, made an appearance on “The Bert Show” Tuesday morning where she spilled even more tea about her relationship with the controversial singer.

As reported by the ajc.com, the former dancer claims Kellz has not paid child support in months because he’s pissed she spoke out publicly about the physical and emotional abuse she allegedly suffered during their marriage.

Andrea and Kelly were married for nearly 10 years and they have three children together — Joann, Jay and Robert Jr.

“He stopped paying child support in June,” she explained on the Atlanta-based syndicated radio show. “It’s another form of abuse. He’s still abusing me financially.”

Drea revealed that she and the kids have not been in contact with R. Kelly, nor do they know his phone number. She also shared that the children call him “Robert Sr.”

“They don’t call him dad,” she said.

Meanwhile, sources tell TMZ that R. Kelly believes Andrea has brainwashed all three of their children into detesting him. Still, the R&B hitmaker is said to miss his children and wants to reconcile with them.

According to RollingOut, R. Kelly produced a song with Joann Kelly about four years ago. But when his ex found out about it, she went ballistic and Kelly believes Drea caused a rift between him and his daughter.

Andrea says she still has not viewed Lifetime’s “Surviving R. Kelly” docuseries, in which she is featured along with nearly a dozen women who share their history of sexual abuse with the artist.

She said the six-part docuseries is “too difficult to watch right now.”

*Unless you’re a serious fan, you probably hadn’t even given it a second thought, but on this date in 1959, Helen Folasade Adu was born in the Federal Republic of Nigeria in West Africa.

“Who?,” some are asking right now. Why, Helen Folasade Adu is none other than uber recording artist, Sade.

Yep, more commonly known as Sade, the soulful, sultry singer rose to fame in 1984 with her best-selling debut, Diamond Life, which was fueled by the hit singles “Smooth Operator” and “Your Love is King” and “Hang On To Your Love.”

Since then, Sade, who releases albums very sporadically, has put out five more albums which have all been fantastic sellers. The lovely, stylish vocalist turns 60 years old today.

Here’s more you might not know about Sade:

After her mother returned to England, Adu grew up on the North End of London. Developing a good singing voice in her teens, Adu worked part-time jobs in and outside of the music business. She listened to Ray Charles, Nina Simone, Al Green, Aretha Franklin, and Billie Holiday, and studied fashion design at St. Martin’s School of Art in London while also doing some modeling on the side.

Around 1980, she started singing harmony with a Latin funk group called Arriva. One of the more popular numbers that the group performed was an Adu original co-written with bandmember Ray St. John, “Smooth Operator.”

The following year, she joined the eight-piece funk band Pride as a background singer. Pride’s opening acts often featured members of the band in different combinations. Pride and their off-shoots performed often around London and stirred up record company interest. Initially, the labels wanted to sign only Sade — technically a trio featuring Adu, Stuart Matthewman, and Paul Denman — while the whole of Pride wanted a deal.

The members of Pride not involved in the Sade trio eventually told Adu, Matthewman, and Denman to go ahead and sign a deal. Adding keyboardist Andrew Hale, Sade signed to the U.K. division of Epic Records.

*A new #MeToo movement-inspired Gillette ad has sparked outrage among some of their consumers due to its rejection of toxic masculinity.

Gillette’s “The Best a Man Can Be” ad debuted Monday, and by Tuesday it was a viral sensation. As noted by SandraRose, the company “challenges the oft used phrase “boys will be boys” that excuses rowdy behavior or rough play that are instinctive to the male species.”

Proctor & Gamble urges men to check their behavior by asking “Is this the best a man can get? Is it?”

In the ad, the narrator says: “We can’t hide from [toxic masculinity]. It has been going on far too long. We can’t laugh it off, making the same old excuses.”

Men (mostly white) are calling for a boycott of Gillette over what they see as an attack on their manhood and their race.

In the commercial, 43 men and boys are shown exhibiting “undesirable” masculine behavior with women and girls. Among the 43 males, 42 are white and only 1 is Black.

7 males are seen exhibiting “desirable” behavior, such as breaking up fights and interrupting men who lust after women. Of the 7 desirables, four are Black males and only 2 are white.

While many are praising the commercial for its “brilliant” message, others complained that the ad is part of the “pussification of America,” and that the company is “hell bent on destroying males.” Piers Morgan tweeted that Gillette is “eager to fuel the current global assault on masculinity.”

The negative tweets and comments in response to the Gillette ad highlight the problem the ad address in the first place; society excusing poor behavior, objectification, and assault of women and children.

One Twitter user wrote: “If you have a problem with this #Gillette ad, it was definitely made for you”

The company posted the ad on Twitter along with the caption: “Boys will be boys”? Isn’t it time we stopped excusing bad behavior? Re-think and take action by joining us at .

*“Get Out” director Jordan Peele is preparing to enter “The Twilight Zone,” with his reboot of the classic sci-fi series that is set to stream on CBS All Access. The Oscar-winner will host and narrate the series, as well as serve as executive producer.

Deadline reports that DeWanda Wise and Jessica Williams are joining the ensemble cast for an episode that will also feature Lucinda Dryzek, Jefferson White and Jonathan Whitesell.

Details about the mystery episode have not been revealed. Previously announced cast includes John Cho, Greg Kinnear, Sanaa Lathan, Kumail Nanjiani, Adam Scott, Alison Tolman, Jacob Tremblay and Steven Yeun.

Wise currently stars as Nola Darling in the Netflix adaptation of Spike Lee’s “She’s Gotta Have It,” which returns this year for its second season.

Williams is the co-creator of “2 Dope Queens” and best known for “The Daily Show.”

In a press release announcing the project back in December 2017, Peele stated, “Too many times this year it’s felt we were living in a twilight zone, and I can’t think of a better moment to reintroduce it to modern audiences.”

The original “The Twilight Zone” was created and presented by Rod Serling, and premiered on CBS on Oct. 2, 1959. The series ran for five seasons from 1959 to 1964. Each stand alone episode explored all things creepy, weird, strange and unusual. All 156 episodes of the original series are available now for streaming on CBS All Access.

“Rod Serling was an uncompromising visionary who not only shed light on social issues of his time, but prophesied issues of ours. “I’m honored to carry on his legacy to a new generation of audiences as the gatekeeper of ‘The Twilight Zone,” Peele previously expressed in a statement.

*Spike Lee has opened up on how he came to team with rock band The Killers, directing the video for their “Land of the Free” single, which he described as “a great protest song.”

Lee says lead singer Brandon Flowers called him up personally to ask if he would collaborate with the band.

“He saw BlacKkKlansman, said he loved it,” Lee told The Hollywood Reporter. He said, ‘What can you do with this?’

The Las Vegas band released the single on Monday and it serves as a response to Donald Trump’s presidency as well as racism and gun violence in America.

As reported by NME, the video was shot by Lee on location as he travelled along the border between the USA and Mexico late last year to capture footage of migrants and the location of Trump’s proposed border wall.

Meanwhile, Spike discussed the timeliness of “BlacKkKlansman” and the government shutdown with THR during a lunch reception for the Producers Guild Awards. The film is up for the top prize at Saturday’s ceremony, but the filmmaker says “The goal is not to be nominated. The goal is to make films of impact, and this film definitely has,” Lee told The Hollywood Reporter.

“I’m not trying to be some grandiose motherf*cker like, ‘Oh, I don’t need awards.’ I’m not saying that. But what I’m saying is that, there are things more important.”

“BlacKkKlansman” centers on the real-life black detective Ron Stallworth, who infiltrated the Ku Klux Klan in the 1970s. Spike believes the timeliness of the film is what made it a hit with critics and audiences.

“I think it really deals with the world we live in today. I keep saying this, but it’s true — ‘The stars were in alignment.’ Everything is timing, really,” he said. “You could do anything — a great song, movie, play, novel — and one little thing in there, it’s not gonna hit. It’s not gonna have impact. It’s timing.”

To illustrate his point, Lee cited The Killers’ new single, “Land of the Free” and pointed out that the song was released during the longest U.S. government shutdown in history.

“Again, it’s about what’s happening. Over 800,000 Americans are on their fourth week of not receiving a check,” Lee said. “People are hurting.”

*Oscar-winning actor Don Cheadle had to remind comedian Kathy Griffin that they were “never friends” after she lashed out at him on Twitter for not supporting her during her 2017 “smear campaign”.

Griffin slammed Cheadle early Tuesday morning for not taking her side when she held up Donald Trump’s bloody, severed head in a since-deleted video.

While many celebrities supported Griffin after she posted the clip online, Don was among the few stars who took to Twitter to note that the footage was probably not a good idea.

Griffin was triggered to attack Cheadle after he posted a photo of himself wearing a hat supporting an anti-bigotry and sexism group.

“Oh GREAT Don. I will never forgive you for your nasty tweet the day my smear campaign started,” she tweeted. “You know it was a f**king smear campaign and you have never taken a moment to apologize. Some liberal you are. Yes, my memory is long my ex friend. Shame on you. I kept a list. Fear me.”

Cheadle, 54, replied, “Huh?” prompting Kathy to add: “Huh? You’re a d**k in real life, but believe it or not I truly hope what I went through never happens to you. Never. And if it did I would be the first in line to stand up for you, get my a** on television and do everything I could to defend you & the 1st amendment. It’s easy don.”

Cheadle replied:

“sigh… ok, kathy. 1) we had one conversation on a flight about our mutual disgust for individual (Trump) 1. i don’t ‘friend’ that quickly so we can’t really be ‘exes’. 2) had i been your ‘friend’ and you had asked my opinion, i would have said, “kathy. for you own sake, please do NOT depict yourself holding the bloody, severed head of the president, evoking daesh (terrorist group ISIS), (beheaded journalist) daniel pearl and every other painful, disturbing memory associated with it, your first amendment rights notwithstanding.” and had you said, ‘fkkk you, i’m doing it anyway,’ i would’ve said, ‘wellgirl, be prepared to have the dogs sicced on you. the secret service doesn’t play around with s**t like that no matter WHO the president is.”

He continued: “you’re also risking your career for what i see as zero upside… maybe you would have listened. doubt it.”

Cheadle called Griffin’s online post “a cringe worthy photo-op”, and added: “i’m sorry that you’re still dealing with the aftershocks of your actions. it’s egregious.”

He also suggested she reach out to him privately, stating: “you wanna rap offline, you know how that works.”

*You can add Mimi Faust (“Love & Hip Hop: Atlanta) to the growing list of celebs who are in trouble with the IRS. It seems that Faust is in debt to Uncle Sam to the tune of $156,000 in back taxes.

Mimi, whose real name is Oluremi Faust, found herself with a massive Federal Tax Lien by the Internal Revenue Service, according to The Blast.

The lien says Faust owes  back taxes for multiple years including $16,952.60 (2013), $59,487.09 (2015) and $80,470.80 (2016) for a grand total of $156,910.49.

By the way, this isn’t Faust’s first rodeo with the tax folks, if you get our drift. She was also recently accused of screwing over the State of Georgia in back state taxes and hit with a lien for an unpaid $26k owed for 2012, 2013, 2015 and 2016.

The reality star has been a star of “Love & Hip Hop: Atlanta” since season one and famously released a sex tape with her ex-boyfriend back in 2014.

She is the ex of co-star, Stevie J, and the two share a child together.

Umm, err, speaking of that scandalous sex tape, Faust, if you missed the news, she confessed to what most people figured out on their own. It was staged.

The “Love and Hip Hop Atlanta” star confirmed the trickery in an interview with Us Weekly as she stated that everything that folks checked out was set up from the very beginning.

According to Mimi, Nikko felt their lovemaking was like art. With that in mind, he believe that it needed to be documented for the public eye. Although she had her reservations, Mimi ended up going along with it.

“We had to say something,” she stated , regarding the lies. “I didn’t tell anybody the truth.”

The reality star’s don’t tell mind state went into effect after “LHHA” Season 3 as she got folks talking with saying the sex tape was stolen from Nikko’s bag at the airport. According to Mimi, footage from the episode made its way to Vivid Entertainment, which reached out to her and Nikko to make a deal.

To ensure a profit would be made from the tape, Us Weekly noted Mimi’s claims at the time about her and Nikko being required to film extra scenes to meet Vivid’s minute requirement.

*Gregg Leakes, the husband of NeNe Leakes (“Real Housewives of Atlanta”) is feeling some kind of way and is apologizing to her (and the world) for hurting her.

“We always hurt the ones we love … because they allow us to hurt them rather than snap back,” Gregg said. “I’m tired of hurting my wife who is only trying to take good care of me and wants only the best for me too.”

As we’ve reported, Gregg has been battling stage 3 colon cancer since the summer of 2018. During his treatment, he underwent surgery but has opted out of chemotherapy. And of course NeNe has hung with him all the way.

“She deserves much more for her hard efforts and tireless hours spent on me,” Gregg added. “I Pray to God to get it together.. She’s done NO wrong… this is ALL on me…… Cancer WILL change your Life.”

Folks have searching for the so-called “pee tape” like thee’s no tomorrow in the wake of the Lifetime Network’s recent airing of the six-hour docu-series, “Surviving R. Kelly

The scandalous tape that led to Kelly’s past indictment on 21 charges of child porn is the subject of massive online searches. Speaking of the charges, Kelly was acquitted by a Chicago jury in 2008.

In any event, porn site xHamster is warning customers/searchers that what they are looking for is “illegal” and “immoral” because it’s a video involving a minor.

The site told The Blast that searches for “R Kelly” are up 388% since January 3, when the Lifetime docu-series premiered. The website does not host any R. Kelly pornography videos, nor do they host the infamous videotape from the early 2000’s allegedly depicting Kelly having sex with, and urinating on an underage girl.

Because of the sudden increase in searches for the video, xHamster took the unusual step of warning searchers that:

“The R Kelly tape is not on xHamster, nor would we ever allow it to be. Regardless of the news or sensation, a tape featuring underaged [children] is both illegal and immoral.”

Also, the site says they will be “disabling searches and putting up messages” alerting any searchers that the content is not available or acceptable.

One of those messages reads:

“Please consider that in searching for and viewing such content, you may be re-victimizing a minor who could not consent.”

Actually, it’s not that difficult to find. All you have to do is Google R. Kelly sex tape and click on “images” and you’ll have more than your eyes can handle.

*Beyonce’s mother, Tina Lawson, decided to comment on the R. Kelly controversy and her social media followers were quick to drag her because her son-in-law hardly has a scandal free reputation.

As reported by Celebrity Insider, Tina was quickly reminded that there is more than a ten-year gap between Jay-Zand her daughter. Not to mention is shady past relationship with a teenaged Foxy Brown.

Jada Pinkett Smith recently did an interview with one of R. Kelly’s accusers on an episode of “Red Table Talk.” The actress dished with Lisa Van Allen about Lifetime’s docu-series, “Surviving R. Kelly.” Lisa says she was 17 when she and the R&B singer had a romantic relationship.

“I came out in 2008 and nobody heard me. In 2008 there weren’t any movements, nobody else was talking about it. I came out hoping that I could help the victims and the girl on the tape because I knew her family wasn’t going to speak. So I felt like, somebody has to stand up. They threatened my life. There was a lot I was dealing with. I was pregnant. You can’t let that stuff stop you. You can’t be afraid.”

*Cameo lead singer Larry Blackmon is reportedly suing four of his former bandmates who he alleges are illegally profiting off of his brand so he’s demanding they pay up $2 million in damages.

According to court documents obtained by The Blast, Blackmon says all Cameo artists were employed as a musicians for hire, including Nathan Leftenant, Arnett Leftenant, Jeryl Bright and Gregory Johnson.

Johnson reportedly left the band in the late 80’s, Nathan and Arnett both quit performing with the band in 2004 and Bright performed with Cameo on and off until 2015, the report states.

Per The Blast:

Blackmon argues the band’s success was due to him controlling the musical direction and stage persona.

The last album Cameo recorded was in 2000 but Blackmon says he has maintained a worldwide performing schedule in the years since performing under the Cameo name.

The singer says for the past few years, the defendants have booked various shows using the Cameo name and have even used his photo in the advertisements.

Blackmon says they never got permission to use the trademark, nor was he paid a dime from the profits they made.

He is demanding in excess of $2 million in damages plus an injunction prohibiting the former members from using Cameo name or his likeness.

As EUR previously reported, Nathan Leftenant, Arnett Leftenant, Jeryl Bright and Gregory Johnson filed a complaint against Blackmon, as noted by The Blast, claiming that in 2010, Blackmon began collecting royalties on behalf of the band, saying he would pay the other members their share. They claim the singer took in $103,005.30 and never paid them a dime.

Blackmon’s business consultant, Jay King, responded to the claim, telling EUR exclusively:

“So the royalties that they’re speaking about are royalties from SoundExchange. SoundExchange is part of the Digital Act that started in 1995, where artists would receive money from digital play. SoundExchange is the equivalent of a performing rights organization. It’s a new revenue stream. So there were more than 100 claims for Cameo. In other words, there were more than 100 people that said they were in Cameo. And there were some guys who were in Cameo that was collecting SoundExchange money five years before Larry Blackmon collected it”

Once Blackman found out about SoundExchange, King says “he shut it down and he started collecting SoundExchange by himself and then more claims came in and that’s when the whole thing got shut down. So nobody’s collecting money.”

Continuing, he added: “Larry doesn’t owe anybody anything because we don’t know who owes what. They haven’t been able to collect SoundExchange money like Larry Blackmon hasn’t been able to collect SoundExchange money because Larry Blackmon said nobody collects this money until this is sorted out. So to file a lawsuit or to make it seem like Larry Blackmon is taking anything from anybody is inconsistent with facts.”
